Welcome to Black Swan Anglers. By accessing our website, purchasing products, registering for events or programs, or participating in any Black Swan Anglers activity, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. About Black Swan Anglers
Black Swan Anglers (“BSA,” “we,” “us,” or “our”) provides fly-fishing education, excursions, events, merchandise, and community-based outdoor experiences. Participation in any BSA offering is voluntary and subject to these Terms and Conditions.
2. Eligibility & Participation

Participants must be 18 years or older, or have written consent from a parent or legal guardian.

Certain programs may require proof of physical capability, prior experience, or completion of waivers.

We reserve the right to refuse participation to anyone whose conduct is unsafe, disruptive, or inconsistent with our values.
3. Assumption of Risk
Fly fishing and outdoor activities involve inherent risks, including but not limited to:

Slips, falls, uneven terrain

Water hazards, weather exposure, wildlife encounters

Use of sharp hooks, tools, and equipment
By participating, you voluntarily assume all risks, known and unknown, associated with these activities.
4. Release of Liability
To the fullest extent permitted by law, Black Swan Anglers, its owners, instructors, volunteers, partners, and affiliates shall not be liable for any injury, loss, damage, or death arising from participation in BSA activities, including travel to and from events.
Participants agree to release, waive, and hold harmless Black Swan Anglers from any claims arising out of participation, except in cases of gross negligence or willful misconduct.
5. Health & Fitness Responsibility
Participants affirm that they:

Are physically and mentally capable of participating

Have disclosed any relevant medical conditions

Will manage their own hydration, nutrition, medications, and personal health needs
Black Swan Anglers does not provide medical advice or emergency medical services.
6. Code of Conduct
Black Swan Anglers is committed to a safe, inclusive, and respectful environment.
We do not tolerate:

Harassment, discrimination, or abusive behavior

Intoxication or illegal substance use during events

Unsafe handling of equipment or disregard for instruction

Disrespect toward wildlife, landowners, or fellow participants
Violation of this code may result in immediate removal without refund.
7. Bookings, Payments & Cancellations

Payment is required in full to secure registration unless otherwise stated.

Cancellation and refund policies vary by event and will be clearly communicated at booking.

Black Swan Anglers reserves the right to cancel or reschedule events due to weather, safety concerns, or unforeseen circumstances. In such cases, participants may receive a credit or refund at our discretion.
8. Merchandise & Sales

All merchandise sales are final unless otherwise stated.

We are not responsible for damage resulting from improper use or normal wear and tear.

Product colors and designs may vary slightly due to manufacturing processes.
9. Photography & Media Release
By participating in BSA activities, you grant Black Swan Anglers permission to use photographs, video, and audio recordings of you for marketing, educational, and promotional purposes, unless you submit a written opt-out request prior to the event.
10. Intellectual Property
All content, logos, designs, written materials, and branding associated with Black Swan Anglers are the intellectual property of Black Swan Anglers and may not be reproduced or used without written permission.
11. Third-Party Services & Locations
Some events may take place on public or privately owned land or involve third-party guides, outfitters, or venues. Black Swan Anglers is not responsible for the actions, policies, or conditions of third parties.
12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
13. Changes to Terms
Black Swan Anglers reserves the right to update or modify these Terms and Conditions at any time. Continued participation or use of services constitutes acceptance of any revisions.
